Terms of Use
These terms govern your use of Brawnly. Please read section 3 in particular: Brawnly is a training log and planner, not medical advice.
1. Scope and provider
These Terms of Use apply to the Brawnly app for iPhone and the related online services (together “Brawnly”). Brawnly is provided by Dennis Donner, Eduard-v-Winterstein-Straße 11, 14480 Potsdam, Germany, app-support@donner.io (“I”). See the legal notice for details. The German version of these terms is legally binding; this English version is provided for convenience.
How I handle personal data is explained in the Privacy Policy.
2. What Brawnly offers
Brawnly helps you plan and log strength training: a weekly plan, routines and programmes, an exercise catalogue with instructions, workout logging with sets, reps, weights and a rest timer, gym setups with machine settings, progress views and an optional connection to Apple Health. Some features need an account, an internet connection or Brawnly Pro (an in-app purchase), for example the AI training plan, detailed charts, records, body-weight tracking and the full history.
3. Training and health — please read
Brawnly is a training log and planning tool. It is not a medical product and does not give medical, therapeutic or nutritional advice.
- Training plans, including AI-generated plans, exercise suggestions, weights and rest times are general proposals based on the details you enter. They do not take your individual state of health into account and can be unsuitable, incomplete or wrong.
- Check with a doctor before you start training, in particular if you have pre-existing conditions, injuries, are pregnant, or have not trained for a long time.
- Learn the correct technique, warm up, choose weights you can control and use a spotter or safety equipment where appropriate. Stop immediately if you feel pain, dizziness or shortness of breath.
- Values from Apple Health and statistics in the app are for your information only and are not suitable for diagnosis.
- You train on your own responsibility.
4. Your account
You can use Brawnly without an account. An account is needed for sync, exercise pictures, the AI training plan and in-app feedback. Provide accurate details, keep your password secret and tell me if you suspect misuse. You are responsible for activity in your account unless you are not at fault.
Brawnly is intended for people aged 16 and over; if you are younger, please only use it with the consent of a parent or guardian.
Deleting your account: you can delete your account in the app under Profile → “Account settings” → “Delete account”; after you confirm, your account and the data synced to it are deleted immediately. Alternatively, write to app-support@donner.io from the email address of your account; I will then delete your account and the data synced to it and confirm the deletion. Data stored only on your device can be removed when you sign out (“Delete local data”) or by deleting the app.
5. Availability and sync
I work to keep Brawnly available, but I cannot guarantee uninterrupted operation. Maintenance, network problems and outages of third-party services can cause interruptions. Workouts can be logged offline; sync happens when a connection is available. In rare cases conflicts between devices can lead to an older version of an entry being kept. Please keep your device backups switched on if your data are important to you.
I may develop Brawnly further and change or discontinue individual features for valid reasons (for example technical progress, changed services or legal requirements), taking your interests into account. For features you have paid for, your statutory rights remain unaffected.
6. In-app purchases
Brawnly Pro is offered as an in-app purchase. Purchases are made through the Apple App Store and are subject to Apple’s terms. Payment, billing, renewal, cancellation and refunds — including any statutory right of withdrawal — are handled by Apple. The current offer and its conditions are shown in the app and in the App Store before you buy.
- Cancel an auto-renewing purchase in your Apple account settings under “Subscriptions”. Deleting the app or your Brawnly account does not cancel it.
- Refunds are requested from Apple (reportaproblem.apple.com) under Apple’s policies.
- Restore purchases on a new device via the app.
7. Fair use
Do not misuse Brawnly. In particular, do not overload, scrape or attack the service, do not bypass technical restrictions or access controls and do not resell the app, its content or the exercise catalogue.
8. Rights to the app
The app, its design, texts, exercise descriptions and pictures, the name Brawnly and the logo are protected. I grant you a simple, non-transferable right to use the app for your own, non-commercial purposes in accordance with these terms. Your training data remain yours. Statutory rights of use (for example under §§ 69d and 69e of the German Copyright Act) remain unaffected.
9. Liability
I am liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act and where I have given a guarantee.
For slight negligence I am only liable if I breach an essential contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible in the first place and on which you may regularly rely). In that case liability is limited to the damage that is typical and foreseeable for this type of contract.
Otherwise, liability for slight negligence is excluded. These limitations also apply to my representatives and agents. For features provided free of charge, the statutory liability privileges apply.
Section 3 applies: you remain responsible for how you train.
10. Termination
You can stop using Brawnly and delete your account at any time. I may terminate or block an account for good cause, in particular for serious or repeated violations of these terms, and otherwise with reasonable notice. Purchases continue under Apple’s terms until you cancel them.
11. Apple
These terms are an agreement between you and me, not with Apple. Apple is not responsible for the app, its content, maintenance or support. Apple’s Licensed Application End User License Agreement also applies; Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase amount; Apple has no further warranty obligation. I, not Apple, am responsible for handling claims relating to the app (for example product liability, legal compliance, consumer protection and intellectual property claims).
12. Applicable law and disputes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country in which you habitually reside.
I am not willing to participate in dispute resolution proceedings before a consumer arbitration board. Any statutory obligation to participate remains unaffected.
13. Changes to these terms
I may change these terms for valid reasons, for example new features or new legal requirements, provided the change is reasonable for you. I will inform you of material changes in the app in good time before they take effect. If you do not agree, you can stop using Brawnly and delete your account; your statutory rights remain unaffected.
